Coverage Depends on the Driver's App Status. Under Colorado's Transportation Network Company law (C.R.S. § 40-10.1-604):

  • App on, no ride accepted yet: $50,000 per person / $100,000 per accident in liability coverage.

  • Actively on a prearranged ride: $1,000,000 in combined liability coverage.

  • Colorado also added required uninsured/underinsured motorist coverage of $200,000 per person / $400,000 per accident through House Bill 22-1089.

What changed with Colorado's rideshare insurance law under HB22-1089?

That law added required uninsured and underinsured motorist coverage on top of existing rideshare liability coverage, giving Colorado riders and other accident victims an additional layer of protection when the at-fault party doesn't have enough insurance of their own.

Am I covered if I was hit by an Uber or Lyft driver while I was walking or in my own car?

Yes - Colorado's layered rideshare insurance rules apply no matter whether you were a passenger, another driver, or a pedestrian. We determine exactly what the rideshare driver's app status was at the time of the crash to identify which coverage applies.

Why does the driver's app status matter so much?

Because it determines which insurance tier responds and how much coverage is available. A driver just logged into the app has far less coverage than one actively driving a passenger, which is why pinning down the exact status at the moment of the crash is one of the first things we investigate.
