How long it takes to resolve your claim is highly dependent on how long it takes for you to get better.

- 09The short answer is that it depends on the law office you retain. Here at The Victory Law Firm, our fee is 33.33% of whatever we recover on your case. This means that if we don't win you don't owe us a dime. This also means that our interests are completely aligned. The more money we recover for you the more our fee is. Therefore, it is our best interest to get you the best outcome that we can.

- 15This comes up a lot and there are usually options. Some providers will treat on a lien basis and wait to get paid until your case resolves, and depending on your situation health insurance or med pay coverage may help in the meantime. - 16Once a case settles, the funds go into our trust account first. From there we pay off any medical liens or bills related to your treatment, subtract our fee and case costs, and the rest comes to you. We'll walk you through exactly what's being paid and why before anything goes out.
- 17Fault gets determined by looking at the evidence: police reports, witness statements, photos, video if it exists, and sometimes accident reconstruction. Insurance companies also do their own investigation and they don't always get it right, which is one reason having a lawyer look at the evidence matters. We dig into the details instead of just accepting whatever the insurance adjuster decides.

Go see a doctor as soon as you notice something is wrong and tell them it's related to the accident. - 19Depends on what you signed. If it was just an exchange of information or a police report, that's normal and doesn't affect your case. If an insurance adjuster got you to sign a release or a statement right after the accident, bring it to us and we'll review it, that doesn't automatically end your claim.
- 20An insurance claim is you or your lawyer negotiating directly with the insurance company to try to reach a fair settlement, no court involved. A lawsuit is a formal legal case filed when negotiations stall or the insurance company won't offer what the case is worth. Most cases resolve through the claims process, but we're ready to file suit when that's what it takes.
- 21Generally no, filing a claim against the at fault driver's insurance shouldn't raise your own rates since you weren't the one at fault. Rate increases are more of a concern when you're the one responsible for an accident. If you're worried about it, bring it up with us and we can talk through your specific situation.
- 22You may still have options through your own policy, specifically uninsured or underinsured motorist coverage if you carry it. There may be some paperwork involved to transfer your file and address the prior attorney's fee, but it's your case and your choice. - 25Typically the at fault driver's insurance covers a rental while your vehicle is being repaired or while liability is being sorted out, sometimes your own policy covers it too if you have that coverage. It depends on the facts of your accident and your policy. Call us and we can point you in the right direction so you're not stuck without a car.
- 26You can often still recover compensation even if you share some blame, depending on the state and how fault gets divided. Being partly at fault doesn't mean you get nothing, it usually just affects how much you recover. We'll be upfront with you about how that plays out in your case.
- 27Usually the recovery comes from insurance, not the individual's personal bank account, so their personal wealth isn't usually the deciding factor. We look at all available insurance coverage, theirs and sometimes yours, to figure out what's actually available to pay a claim. This is exactly the kind of thing we sort out for you at Victory Law.
